Terms of service

1. Who we are

These terms are between you and Quarity Ltd ("Quarity", "we", "us"), a company registered in Northern Ireland with company number NI664006, of 76 Doagh Road, Newtownabbey, BT37 9NY. You can contact us through our contact form.

They cover our Crowvio service (at https://crowvio.quarity.co.uk) and our event management and event networking services. By creating a Crowvio account or booking a service, you agree to them. If you're accepting them for an organisation, you confirm you're allowed to do so.

2. Our services

  • Crowvio is an online service for running live audience games and activities on a big screen and on players' phones. It's sold as a subscription.
  • Event management and event networking are services we provide for a specific event, under a quote or booking confirmation. If the quote says something different from these terms, the quote applies.

3. Your Crowvio account

  • Give us accurate details and keep them up to date.
  • Keep your sign-in details safe. You're responsible for what happens under your account, including what your team members do.
  • Tell us straight away if you think someone else has got into your account.

4. Free trial, payments and renewal

  • New subscriptions start with a 14-day free trial. We take your card details at the start but don't charge you during the trial. During the trial, up to 50 players can join at once. You can start your plan early from the control room: your card is charged then, and the trial ends.
  • When the trial ends, your card is charged for the plan you chose, monthly or yearly, unless you've cancelled.
  • Your subscription then renews automatically at the end of each month or year, and we charge your card at the start of each period, until you cancel.
  • Each plan includes up to 250 players at once. If your events regularly go over that, we'll talk to you about our large events option. We won't cut off an event that's already running.
  • Plans and prices are shown on our Crowvio page and in Crowvio before you subscribe, in pounds sterling (GBP), including for customers in the Republic of Ireland; your card provider converts the amount if your card is in euros.
  • Payments are processed by Stripe. If a payment fails, we'll try again and let you know. If we still can't take payment, we may pause or end your subscription.
  • We may change our prices. We'll tell you at least 30 days before a change affects you, and it will apply from your next renewal. If you don't want to pay the new price, you can cancel before then.

5. Cancelling

You can cancel at any time from Billing in your Crowvio account or by emailing us. Your access continues to the end of the period you've paid for. Our refund and cancellation policy explains when we give refunds and forms part of these terms.

We may suspend or close your account if you seriously or repeatedly break these terms, or don't pay. Where it's reasonable, we'll warn you first and give you a chance to put it right.

6. Using Crowvio responsibly

You're the organiser of your events, so you're responsible for how Crowvio is used at them. Please:

  • don't use Crowvio for anything illegal, harmful, hateful or misleading;
  • only upload content (logos, pictures, music, questions) you have the right to use;
  • keep an eye on what players post to selfie and message walls, and use the moderation tools to remove anything inappropriate;
  • tell your players how their names, photos and messages will be used at your event, and get any consent you need, especially where children are taking part;
  • don't try to break, overload, copy or get around the security of Crowvio.

7. Your content and data

Content you and your players add to Crowvio stays yours. You give us permission to store it, show it and process it only so we can run the service for you. When Crowvio processes personal data about your players, we do it on your behalf, as your data processor, under our data processing terms. Our privacy policy explains how we handle personal data.

8. Our content

Crowvio, its software, designs, built-in themes and pictures belong to us or our licensors. You may use them through the service while your subscription is active, but you can't copy, resell or reuse them elsewhere.

9. Availability and changes

We work hard to keep Crowvio running smoothly, but we can't promise it will never be interrupted, for example during maintenance or because of problems outside our control, such as venue Wi-Fi or mobile signal. We may improve and change Crowvio over time. If we remove something important from your plan, we'll tell you in advance, and you can cancel and get a refund for any time you've paid for but not used.

10. Our responsibility to you

  • Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.
  • We're not responsible for losses that we couldn't reasonably have foreseen, or for business losses such as lost profits, revenue or opportunities.
  • Otherwise, our total liability to you in any 12 months is limited to the amount you paid us in those 12 months.
  • If you're a consumer, these limits apply only as far as the law allows, and you keep your legal rights.

11. Changes to these terms

We may update these terms. If a change matters, we'll email account holders at least 30 days before it takes effect. The date at the top shows when they were last changed.

12. Law and disputes

These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland can deal with any dispute. If you're a consumer living elsewhere in the UK or in the Republic of Ireland, you keep the protection of the consumer law where you live and can also bring a claim in your local courts. Please talk to us first; most problems can be sorted out quickly by email.
